What these terms cover
These Hosting and Billing Terms apply to the website hosting, domain registration, business email, SSL certificates, website care and security plans, and other recurring services LOJO Group, LLC dba LOJO Marketing (“LOJO”) provides through our client portal at lojo.hosting (the “Services”). By ordering, paying for or using the Services, you (“Client”) agree to these terms, our Privacy Policy and Terms of Use, and the specific terms of your order, proposal or agreement.
If your signed proposal or Master Service Agreement says something different from these terms, your signed agreement controls for that engagement.
Your account and the client portal
Your client portal is where you view invoices, update payment methods, manage domains and open support requests. Keep your login confidential and your contact and billing details current. You are responsible for activity under your account.
We use the contact information on your account for billing notices, renewal reminders and service alerts, so please tell us when it changes.
Billing and payment
Website hosting. Hosting renews on the 10th of each month, or on the 10th of your renewal month for annual plans. Your first invoice is prorated from your sign-up date to the next 10th, so every hosting account renews on the same day. Hosting is paid by card.
Other recurring services. Systems, care plans and other monthly services are billed on the 15th of each month as prepayment for the upcoming month. These services can also be paid by ACH draft.
One-time fees, such as setup or project deposits, are due before work begins. Annual services, such as domain registrations, are billed before they renew.
A 3% processing fee applies to card payments. It is waived for services paid by ACH draft. Fees do not include sales or similar taxes, which are added where we are required to collect them.
A payment method on file is required for recurring Services, and you authorize us to charge it for each billing period until you cancel.
Late payments and suspension
A 3% late fee applies to payments not received when due, including payments returned for insufficient funds or other payment errors.
If an account is 15 days past due, we may suspend the Services, which can take your website, email or other Services offline. Services are restored after all past-due amounts and late fees are paid. Accounts that remain unpaid may be cancelled and sent to collections for the full balance owed.
Please contact us before disputing a charge with your bank. An unresolved chargeback is a breach of these terms, and you agree to reimburse the fees and costs it causes.
Term, renewal and cancellation
Website hosting is offered monthly or annually, based on the plan you choose, and renews automatically for the same period until cancelled. Unless your order or signed agreement states a committed term, every other plan is month to month and renews automatically each month.
To cancel, send written notice by letter or email at least 30 days before your next renewal. Fees for periods already served, setup fees, partial months and the unused portion of an annual plan are not refundable.
We may update pricing or plan features with at least 30 days written notice before a renewal.
Hosting, backups and availability
We host websites on managed servers that are monitored around the clock and maintained by our long-time hosting partner. We work to keep every site online, fast and secure, but no host can promise uninterrupted service. Outages, maintenance, third-party failures and events outside our control can cause downtime and are not a breach of these terms.
We keep regular backups of hosted websites. When a site is restored from a backup, changes made after that backup may be lost. Keep your own copies of important content.
Each plan includes the storage, bandwidth and resources stated in your order. If your site regularly exceeds them, we will contact you about an upgrade before additional charges apply.
Website care and security plans
Care and security plans include the updates, monitoring, firewall protection and restoration described in your plan. Custom or incompatible plugins and code may need extra work that is quoted separately.
Malware cleanup and restoration are included only in plans that list them. Sites without an active care plan can fall out of date and become vulnerable, and repairs for those sites are billed at our standard rates.
New websites we build include a 30-day warranty on our code after launch. After that, updates and fixes are covered by your care plan or quoted separately.
Domain names
Domains we register for you are registered in your business’s name and remain yours. We manage and renew them for you while your account is current.
If an account is cancelled or unpaid, a domain may expire at the end of its registration period. On request, and once your account is paid in full, we will help transfer your domain to a registrar you choose.
Business email
Hosted email accounts are subject to the storage limits of your plan. You are responsible for the content of messages sent from your accounts and for keeping passwords secure. Email may stop working if your account is suspended or your domain expires.
Acceptable use
You may not use the Services to host or send anything illegal, infringing, fraudulent or harmful, including malware, phishing pages, spam or bulk email sent without consent, or content that exploits minors. You may not attempt to break into other accounts or servers, or use the Services in a way that degrades performance for other clients.
We may suspend Services immediately to protect our servers, other clients or the public, and we will tell you why as soon as we reasonably can. Serious or repeated violations may lead to termination without refund.
Your content and responsibilities
You own your website content and are responsible for its accuracy and legality and for having the rights to everything you publish. You agree to respond to our requests for information or approvals promptly, since delays can extend timelines or add cost.
When Services end
When a plan ends, we will provide a copy of your website files and help with handoff on request, once your account is paid in full. Services delivered through our licensed platforms, such as consent banners or software subscriptions, stop when the plan ends. Data left on our servers is deleted after a reasonable period following cancellation.
Liability and indemnification
LOJO is not liable for losses caused by security breaches, third-party outages, changes you make to your site, or events outside our control. Our total liability will not exceed the amount you paid LOJO for the affected Services in the twelve months before the claim. We are not liable for indirect, consequential or lost-profit damages.
You agree to indemnify LOJO against claims arising from your content, your website, your use of the Services or your business operations.
Governing law
These terms are governed by the laws of the State of Tennessee. Venue for any dispute lies in Wilson County, Tennessee. If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms by posting a new version on this page.
